Will of John Wood (born Warehorne 1789, died Lydd 1877)

 

This is the last Will and Testament of me John Wood the Elder of Lydd in the County of Kent Grazier I direct that all my just debts funeral and testamentary expenses be paid by me executors herein after named as soon as conveniently may be after my decease. I give unto my daughter Elizabeth WOOD one feather bed and three silver teaspoons. To my daughter Harriet the wife of Alfred COBB three silver teaspoons. To my son George WOOD my gun and two carts which are now in his possession for his absolute use but it is my use that after his death the gun shall be preserved in the family. My watch with its appendants I give to my son Charles WOOD. I give my wearing apparel unto and among my sons John, George, Thomas, Charles and Henry and if any dispute shall arise in the division the same shall be settled by Edward Thomas BASS one of my executors herein after appointed. All the residue of my household goods and furniture and all my live and dead stock moneys chattels and effects whatsoever I give unto my son the said George WOOD and the said George WOOD and the said Edward Thomas BASS of Lydd aforesaid graziers their executors administrators and assigns upon trust as to the said residue of household goods and furniture to permit my dear wife Elizabeth WOOD to have free use and enjoyment thereof for her life and upon trust that my said trustees do at Michaelmas which shall come next after my decease sell all my said live and dead stock on public auction and convert the residue of my personal estate and effects into money and to invest the proceeds on real or government or other securities as to them may seem proper and out of the dividends and annual produce thereof or out of the capital if the annual income shall be insufficient pay to my said wife the sum of seven shillings weekly and every week during her life. And as soon as conveniently may be after the decease of my said wife I direct said trustees to sell the residue on my said household furniture and effects by public auction and add the proceeds of such sale to the then existing capital and to apply the capital so augmented and to hold the same in manner and upon the trusts following namely upon trust to pay five twelfth parts there of unto and equally between my daughters namely Harriet the wife of Alfred COBB, Ann the wife of William MARTIN, Susannah the wife of ….BALL, Charlotte the wife of Thomas SIMS and my unmarried daughter Elizabeth WOOD and I declare that the same shall be paid to each of them for their own sole and separate use and benefit and free from the debts control or engagements of their respective husbands and so that their respective receipts alone shall be good discharges for the same And as to one other twelfth part upon trust to pay one moiety thereof unto the wife of my son Henry for her sole and separate use and free from his debts control or engagements and so that her receipt alone shall be a sufficient discharge for the same and I direct my said trustees to retain the other moiety of the said last mentioned twelfth part upon trust to pay and apply the same for the benefit on my said son Henry in such manner and at such times as my said trustees in their uncontrolled and absolute discretion shall think fit And as to one other twelfth part upon trust pay the same to my said son George WOOD to be held by him upon trust for the four children of my late daughter, Mary SIMS in equal shares and to be applied for their benefit in such manner and at such times as the said George WOOD shall think proper but if any or either of them shall die under the age of twenty one years without leaving issue the share of the one or more dying shall go over to the survivors equally And as to the remaining five twelfths parts of the said trust moneys I direct my said trustees to retain the same upon trust to pay and apply the same for the benefit of my son George, Thomas, Charles William and John in such manner and at such times as my said trustees shall in their absolute and uncontrolled discretion think fit but so that my said sons George Thomas Charles William and John shall take the said five twelfth parts in equal shares as tenants in common. And I direct that if any of my children die before my said wife and without leaving issue his or her share shall go over and be equally divided between my surviving children and the said children of my deceased daughter Mary SIMS but her said children shall only take the part which their mother if living would have taken and such accrued part shall be held by my said son George WOOD upon trust for them and applied in the same manner as the original vested share I devise all estates vested in me as trustee or mortgagee unto and to the use of the said George WOOD and Edward Thomas BASS their heirs executors administrators and assigns subject to the trust and equities affecting the same And I appoint the said George WOOD and Edward Thomas BASS EXECUTORS of this my Will and revoke all others by me heretofore made

In witness whereof I have hereunto set my hand this twenty ninth day of October one thousand eight hundred and sixty four – JOHN WOOD signed by the said john WOOD the testator as his last Will and Testament in the presence of us present at the same time who in his presence and at his request and in the presence of each other have hereunto set our names as witnesses – James BUSS jnr Inn Keeper LYDD – Henry STRINGER Solr. Proved at London 12th May 1877 by the oath of Edward Thomas BASS the surviving Executor to whom Admin was granted.

Note – John died 22nd February 1877 – Effects were under One Hundred Pounds.
